INSTAGRAM GIVEAWAY RULES

General provisions

  1. The organizer of the giveaway is the "WHOSE Borys Skowron" company , operating at the following address: ul. Leg. Half. 129/44, 41-300 Dąbrowa Górnicza, with the assigned tax identification number (NIP): 6292507268 (hereinafter referred to as the "Organizer").
  2. The giveaway will be held in accordance with these regulations, (hereinafter referred to as the "Regulations") available at https://whosethatbag.com , as well as the provisions of Polish Law, in particular the provisions of the Civil Code.
  3. The giveaway is not a game of chance, a raffle or a promotional lottery within the meaning of Art. 2 section 1 of the Gambling Act of November 19, 2009 (Journal of Laws of 2009, No. 201, item 1540, as amended) and is not subject to the regulations contained in the above-mentioned. Act and implementing regulations to this Act.
  4. The Organizer informs that the Giveaway is in no way sponsored, supported, administered or associated with www.instagram.com/ and www.facebook.com .
  5. The information provided by the person registering to take part in the Giveaway is information provided to the Organizer, not to Instagram. This information will be used to conduct the Giveaway by the Organizer, under the conditions specified in the Act of May 10, 2018 on the protection of personal data (Journal of Laws of 2018, item 1000) .
  6. The Organizer supervises the correctness and course of the Giveaway, i.e. providing information about the Giveaway and considering complaints.
  7. Participation in the Giveaway is voluntary. By entering the Giveaway, the Participant accepts all provisions contained in the Regulations.
  8. The Regulations are binding on the Organizer and Participants. The conditions of participation in the Giveaway are specified exclusively in the Regulations. All additional promotional and advertising materials are for informational purposes only.

Participants of the Giveaway

  1. A participant in the Giveaway (hereinafter referred to as the "Participant") may be a natural person who meets all of the following conditions:
  • has an active account on Instagram;
  • has read the content of these Regulations and voluntarily enters the Giveaway;
  • agrees to and accepts the terms of the Regulations, including having read the content regarding the prize collection procedure and fully accepts it;
  • has met the conditions provided for in the Regulations;
  • undertakes to comply with the provisions of the Regulations, including the Instagram regulations;
  • consented to the processing of personal data for purposes related to participation in the Giveaway.
  1. The Organizer's employees cannot participate in the Giveaway.
  2. The right to verify compliance with the above conditions of participation rests exclusively with the Organizer.

Time and place of the Giveaway

  1. The giveaway lasts from December 22, 2023 to December 23, 2023 at 11:59 p.m. ( hereinafter referred to as the " Giveaway Duration").
  2. The giveaway takes place on Instagram on the profile https://instagram.com/whosethatbag 

Giveaway Rules

  1. In order to take part in the Giveaway, the Participant should complete the Task consisting of:
  • Following the Organizer's profile on Instagram,
  • Sharing the post with the giveaway on your story,
  • Liking the last 3 posts (including the post with the giveaway) and inviting 3 people to participate by tagging them in the comment below the post,
  • Answers in the comment to the question: What are your plans and goals for 2024 and how can our WHOSE BAG help you achieve them?
  1. The comment cannot contain vulgarity, offensive or illegal content.
  2. The Giveaway Participant declares that he or she has full copyright to the content of the comment.
  3. Only entries received by the Organizer by the end of the Giveaway Period are taken into account in the Giveaway.

Awarding prizes

  1. The prizes (hereinafter "Prizes") to be won in the Giveaway are:
  • I. Prize - A bag and a limited edition mug chosen by the winner
  • II. Reward - Discount code (-50%) for ordering at whosethatbag.com
  • III. Reward Discount code (-25%) for ordering at whosethatbag.com
  1. The prize awarded in the Giveaway cannot be exchanged for another prize. The participant is also not entitled to request that the prize be exchanged for a cash equivalent.
  2. Giveaway winners have the right to refuse to accept the prize. An unaccepted prize is transferred to the next person in the ranking, and the winners are not entitled to financial compensation in this respect.
  3. In order to acquire the right to the prize, the winners are obliged to send a private message on Instagram with the following data within 7 days of receiving information about the win from the Organizer: name, surname, residential address or address of the nearest InPost parcel locker point, contact telephone number and e-mail address.
  4. No message from the Winner in the above-mentioned deadline is considered a waiver of the prize.

Selecting the Winners and issuing the Prizes

  1. From among the Entries that meet the requirements of the Regulations, the Organizer will select a total of 3 Prize winners who, in his opinion, answered the question in the most interesting, creative and original way. Participants whose Entry is selected according to the criteria indicated in the previous sentence are hereinafter referred to as the " Giveaway Winners".
  2. Within 2 business days of the end of the Giveaway, the names of the Prize Winners' profiles will be published on the Organizer's Instagram profile.
  3. The Organizer will contact the Participants via private message on Instagram within 2 business days from the date of announcing the Prize Winners in order to determine the details of the Prize implementation and obtain the data specified in §5 point 4.
  4. In case of suspicion of activities inconsistent with the Regulations, the Organizer reserves the right to disqualify the Participant.
  5. The Organizer has the right at any time to immediately exclude from the Giveaway a Participant who acts inconsistently with these Regulations, has undertaken or is attempting to influence the result of the Giveaway in any other way.

Processing of personal data

  1. The personal data of the Giveaway Participants will be processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 /EC (hereinafter: " GDPR "), as well as in accordance with the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).
  2. The administrator of the personal data of the Giveaway Participants is the company "WHOSE Borys Skowron", operating at the following address: ul. Leg. Half. 129/44, 41-300 Dąbrowa Górnicza, with the assigned tax identification number (NIP): 6292507268.
  3. The basis for the processing of the Giveaway Participant's personal data is the legitimate interest of the Organizer resulting from the implementation of the provisions of the Regulations and the voluntary participation of the Giveaway Participant in the Giveaway. Providing data is voluntary, but if the data is not provided, the Giveaway Participant will not be able to take part in the Giveaway. The basis for data processing is also the legitimate interest of the Organizer consisting in considering complaints.
  4. The personal data of the Giveaway Participants are processed by the Organizer for the duration of the Giveaway, its settlement, awarding of prizes and consideration of complaints, and then for archival purposes for a period in accordance with applicable regulations. Personal data are processed on the basis of consent until it is withdrawn.
  5. The Giveaway Participant has the right to access personal data, the right to rectify, delete or limit processing and the right to transfer data.
  6. When the data is deleted, the User loses the opportunity to participate in the Giveaway.
  7. The Giveaway Participant has the right to lodge a complaint in connection with the processing carried out by the Organizer to the President of the Personal Data Protection Office - the body supervising the protection of personal data in Poland.

Complaints

  1. Participants should report any complaints regarding the manner of conducting the Giveaway to the Organizer in the form of a private message on Instagram or by e-mail to marketing@whosethatbag.com during the Giveaway, but no later than within 7 days from the date of issuing the Prizes.
  2. A complaint submitted after the deadline has no legal effects.
  3. Complaints will be considered within 30 days, in the form of a private message or e-mail to the Giveaway Participant.

Final Provisions

  1. The Regulations enter into force on December 22, 2023. and valid until December 31, 2023.
  2. In matters not regulated by these Regulations, the provisions of the Civil Code and other legal provisions shall apply.
  3. Disputes relating to and arising from the Giveaway will be resolved by a common court having jurisdiction over the Organizer's registered office.
  4. The Organizer reserves the right to change the rules of the Giveaway during its duration. Information about changes will be posted on the Organizer's Instagram: https://www.instagram.com/whosethatbag 
  5. The deal is not a game of chance within the meaning of Art. 2 of the Act of November 19, 2009 on games of chance (Journal of Laws No. 201, item 1540, as amended) and is not subject to the rules contained in the above-mentioned. Act and implementing regulations to this Act
